Concerns with Pine/Bailey's Newest Transfer Station

Last week concerned citizen Mike Moonan contacted the Beacon regarding communications between himself and the County, specifically the former interim County Manager/Director of Operations. Mr. Moonan attempted to gather information via CORA requests; the information requested includes:


 1. Approved excavation or grading permit, including associated documents showing acres disturbed.

2.Excavation or grading permit status.

3. If readily available and on file, the county copy of the CDPS GENERAL PERMIT COR400000 STORMWATER DISCHARGES ASSOCIATED WITH CONSTRUCTION ACTIVITY AUTHORIZATION TO DISCHARGE UNDER THE COLORADO DISCHARGE PERMIT SYSTEM (CDPS) required for eath disturbances >1 acre

4. If item 2 is not on file or not required, please provide a rationale why it was not required. 5. Approved Building Permit

6. Building permit status

7. Temporary certificate of occupancy or certificate of completion with conditions (if applicable)

8. Certificate of occupancy or certificate of completion For the Askagg LLC project in the Wandcrest Development.  Temporary Certificate of Occupancy or Certificate of completion, if applicable Certificate of occupancy or certificate of completion (if applicable) for the Askagg LLC project in the Wandcrest development.


According to Mr. Moonan's letter to the County the above requests have not been produced.


Within this communication to the County Mr. Moonan points out to Mr. Smith the records that should be available by code "104.7 Department records. The building official shall keep official records of applications received, permits and certificates issued, fees collected, reports of inspections, and notices and orders issued. Such records shall be retained in the official records for the period required for retention of public records." Mr. Moonan provides 18 items that should be easily provided to the public regarding building/driveway permits, excavation/grading permits, Erosion Control Plan sheet and a copy of the SWMP & Erosion Control Details, building permits, temporary building permits if applicable. Please see the communication (pp.3-6) provided below by Mr. Moonan for further details of his request.




At this time the County was non-responsive to the CORA request. The question remains when will the County provide this information to Mr. Moonan and how much did Mr. Smith know. As Mr. Smith was recently terminated from his position as interim County Manager and Director of Operations hopefully his replacement will provide this concerned citizen the answers to his questions.
